BEAUTYINNOVATORS COMMUNITY NEW MEMBER SWEEPSTAKES RULES
THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE 50 STATES OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA AND IS GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT LOCATED IN THE UNITED STATES. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. ENTRY IN THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.
Each individual Sweepstakes (“Sweepstakes”) will be announced via a post within the Service (as defined in the Participation Terms) (“Sweepstakes Posting”). A Sweepstakes Posting will include the number of points required to receive one or more entries into the applicable drawing, the start and end times and dates (“Sweepstakes Period”), and the prize(s)/value(s). All information contained in a Sweepstakes Posting is incorporated herein by reference.
ELIGIBILITY: This Sweepstakes is open to legal residents of the fifty (50) states of the United States and the District of Columbia who are 18 years of age or older as of the date and time of entry. Void where prohibited. All federal, state and local laws and regulations apply. Employees of Shiseido Americas Corporation, its parent, subsidiaries, affiliated companies, advertising and promotion agencies, and their immediate family members (parents, children, siblings and spouses of children or siblings) and household members are not eligible. Failure to comply with all rules and regulations associated with the Sweepstakes could result in disqualification from the Sweepstakes. Sponsor reserves the right to, in its sole discretion, cancel, modify or suspend this Sweepstakes for any reason.
HOW TO ENTER: During the Entry Period, register as a new member in the BeautyInnovators Community and complete one (1) survey and/or activity by Friday, December 1, 2023 to be automatically entered into the drawing. Existing members of the BeautyInnovators Community are not eligible to participate in this sweepstakes. Entries must be earned during the applicable Entry Period to be eligible for that drawing. Activity completions or entries generated by script, mechanical, macro or other automated means or by any means which subvert the entry process are void. Questions regarding this Sweepstakes should be directed to Sponsor by sending your question to customercare@cledepeaubeaute.com. To enter without completing any survey and/or other activities as above, you may email Support@beautyinnovators.com during the Entry Period and provide their first and last name and email address to enter this sweepstakes.
ENTRY PERIOD: 12am ET on March 15, 2023, and ends at 11:59 PM ET on December 1, 2023
PRIZE: Five (5) winners will be selected, and each winner will win a prize consisting of Clé de Peau Beauté products valued at $300 or more.
Estimated retail value of each product: $300. Total Sweepstakes Prize Retail Value: $1,500.
Gift cards are subject to terms and conditions specified by issuers.
All federal, state and local taxes on the prize are the sole responsibility of the Sweepstakes winners. No substitutions or other alternative is available, except that Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. Sponsor will not replace any lost or stolen prizes. Winner agrees that any prizes are personal to that applicable winner, and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated or otherwise conveyed. Limit one (1) prize per person per year. Unclaimed prizes will not be awarded.
WINNER SELECTION AND NOTIFICATION/VERIFICATION: Winners will be selected in a random drawing from all eligible entries received on or about December 15, 2023 for that Sweepstakes. Odds of winning the Sweepstakes depend on the total number of eligible entries received for the applicable Sweepstakes Period. Nonwinning entries from one Sweepstakes Period will not be included in any subsequent Sweepstakes Periods. Potential winners will be notified by the Sponsor via email. Potential winners may be required to demonstrate control of their email account. Sponsor is not responsible for any change of email address of entrants. The potential winners must then contact Sponsor within seven (7) days of attempted notification, or the prize will be forfeited. In the event of non-compliance with these Official Rules, or if a prize notification or prize is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner at Sponsor’s sole discretion. Each winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”).
LIMITATION OF LIABILITY Sponsor will not be responsible or liable for failure to receive entries due to transmission failures or technical failures of any kind, including without limitation, electronic malfunction of any network, hardware, or software. Sponsor reserves the right in its sole discretion to cancel or suspend the Sweepstakes should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the Sweepstakes. In the event of cancellation of any Sweepstakes, the prize will be awarded in a random drawing from eligible entries received prior to cancellation.
GENERAL RELEASE By participating, entrants release Sponsor and its affiliates, subsidiaries, participating partners, advertising or promotions agencies, and the respective employees, officers, agents, directors of each of the above, from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with this Sweepstakes or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injury or death, damage to, loss or destruction of property or privacy, defamation, or portrayal in a false light). Each entrant waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and agrees that all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforce ability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of New York without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state, and local courts located in New York, NY for the resolution of any and all disputes arising out of entrants participation in the Sweepstakes.
WINNER PUBLICITY Sponsor may wish to publish the first name, first letter of last name, likeness and location (city/state) of the Winners, and by accepting a prize, the Winners expressly authorize Sponsor to use, reproduce, distribute and publicly display his or her names, likeness and location in connection with the promotion of this or any other Sweepstakes, except where such requirement is prohibited by law.
